In N.Y. state you have to have 45 pound draw weight or more to hunt big game. Can you use a crossbow in your state...

38 pounds of dynamite would work ---as Charlie says just too light and you run the risk of a wounded or aggravated bear that could result in you being hunted instead

38 is too light for bear you would have a high risk of inadequate penetration through their thick hair, hide and fat. Most hunters use 55+. Perhaps you can find a bow with 80% let off enabling you to pull 55 or 60. Or just use a gun until you can shoot an adequate bow.
If you call the bear with predator call to the gun it will be exciting perhaps even more so than sitting in a tree waiting for the bear to come and eat on the bait pile.

I would wait until you have the ability to pull back a heavier bow.

could it?,possibly.but I would use a higher poundage bow.In my parts 45lbs in the required minumum poundage for all big game archery hunts.
